The College of Islamic Sciences at the University of Baghdad discussed the master’s thesis on (Editing the dispute between the Malikis and the Shafi’is in the issues of sales in the two books “Al-Tahmid” by Ibn Abd al-Barr and al-Majmo’ al-Nawawi) by the student (Sami Jassam Mohammad) from the Department of Sharia -Islamic Law-. The viva was held at Al-Zahra Hall.

The importance of the research lies in the fact that it studies the subject of jurisprudence which represents one of the great sciences. Jurisprudence is a science that every Muslim needs, especially the students of knowledge. Studying Jurisprudence is very necessary to reach the pleasure of God Almighty. The need for jurisprudence of sales is renewed at all times in what emerges from sales and what develops and what people are familiar with and what they are not. And the jurisprudence of sales is something that is needed in every time and place, so it differs, for example, from the jurisprudence of Hajj which Muslim does not need it except once a year or perhaps in a lifetime. Unlike the jurisprudence of sales, so we may need it at all times because the whole life depends on buying and selling.

The letter comes out with a number of results and recommendations, including The content of the letter issues related to sales in which scholars differed, and I singled out the scholars of the great schools of thought in matters of sales, in which they differed in the two books Al-Tahmidh by Al-Hafiz Ibn Abd Al-Bar, and Al-Majmoo’ by Imam Al-Nawawi, and he found in them nearly thirty issues. They differed about it these two books with regard to sales, and my letter began with the translation of these two great scholars, showing their lives, and what pertains to them, in advance of Imam Ibn Abd al-Barr and then Imam al-Nawawi.

The thesis was approved with (Eligible) estimation by the discussion committee consisting of Dr. Mahmoud Bandar as Chairman, Dr. Mustafa Adnan and Dr. Hana Muhammad as members and Dr. Sami Jamil as a member and supervisor.

To closely follow the scientific atmosphere, the discussion was attended by Prof. Dr. Nima Dahish Farhan, The Dean of the college, and his administrative assistant, Dr. Arkan Rahim Jabr.
