[vc_row][vc_column][vc_column_text css=””]The College of Islamic Sciences at the University of Baghdad Discussed the Thesis: “The Fundamental Principles of Issues Related to Contemporary Medical Rulings” by Student Latif Muhammad Abbas from the Department of Islamic Law in the Al al-Bayt al-Atyab Hall.
\nThe importance of the thesis lies in its study of newly emerging issues related to contemporary medical rulings. It traces the foundational principles, bases, and fundamental evidence for these rulings, aiming to establish the basis of Sharia, which is centered on bringing about benefits and preventing harm. This approach helps avoid falling into prohibited areas of Sharia, as the preservation and honor of human beings are fundamental in Islamic law. Moreover, it ensures that humans do not violate God’s universal laws or contravene His Sharia rulings to achieve their desires and goals.
\nThe thesis concluded with a number of findings and recommendations, the most important of which are: Permissibility of Using Genetic Fingerprinting to Establish Lineage in Cases of Li’an: This allows for the combination of Sharia and science in proving lineage. However, from a Sharia perspective, the explicit text of the lawgiver takes precedence over what is established in medical sciences, as divine knowledge has aspects that may be hidden from us. Prohibition of Human Cloning by Any Method Leading to Human Reproduction: This includes both main methods and any other methods that result in human reproduction. Permissibility of Milk Banking: It is permissible because breastfeeding is only established under two conditions: (1) Suckling directly from the breast and (2) Nutritional intake from the milk. Additionally, the establishment of milk banks does not lead to any prohibited actions under Sharia, as the principle of permissibility applies and there is no text explicitly prohibiting it.
\nThe thesis was approved with a satisfactory grade by the discussion committee, which consisted of:
